Appeal allowed from FTT what next?

The judge said that it was harshly unjustice to Expect from me to go back to india and make a fresh application. He also said that HO have made errors in my refused application and if it wasnt the errors i would have got my visa by now. He added that the decision appealed against would cause the united kingdom to be in breach of law. It all sounds very pleasing but what can i expect. Decision was made on 5th sept, heard nothing yet.

Would you be able to share your case and hearing. I have my appeal hearing next month based on flr fp (my british partner) and home office says that my partner should relocate to my home country.
Normally home office has 14 days to challenge jude's decision and if they dont you would roughly get your visa within 3 months time.

I have already posted the whole story there. My case is different than yours. HO claimed i was overstayed for 3 months before i applied for spouse visa. But i had all there letters so judge agreed to us that i wasnt overstayed virtue of section 3C. I hope all goes well for you the worst wait in the world is UK spouse visa wait where you k ow HO is trying there best to not issue you a visa even if you are right

Thanks for replying back, and if you read my story i have bee through appeal process previously where judge allowed my spouse visa within uk, home office implemented it and i had 2.5 years visa which expired in may 2016. When i applied for extension home office refused me saying you only lived in uk for 6 months when i legally staying in uk since january 2009. so i am going through appeal process again. Waste on money and time.
So far the ground i have are
my british partner, paying tax regularly as we both are in professional jobs. Will be becoming father next month In shaa Allah.Wife's all family in uk. most of my family in uk as well.

Lets see how judge looks at all these proofs. Most interesting thing is i will be going to same court which gave me visa 2.5 yrs ago

oh congratulations, i hope you get both the good news soon. I am not very experienced in this. But trust me home office do act weird. They claimed i was overstayed three years ago. That according to them was only for 3 months. I picked up all the decision letters they sent me jusge saw the dates on them and thats it clear case. Looking at your case i think ho is doing exactly the same to u. Best of luck and please do share about your hearing

I just wanted to ask, when u got ur appeal Allowed did HO appealed against it ?

In my case no. Home office didnt appeal the decision from ftt judge in 2012 and gave me visa within 3 months from the date of decision

can i just ask you about the three months. Is that from the date of decision or three months from the date of promulgation date?

All appeals take ages maybe 12-18 months. InshaAllah you get the date fast and a positive result.
