Need help with Spouse Visa - Online form filling and Evidences

Post by ganesh46 » Tue Sep 12, 2017 5:34 pm

Hello All,

First of all apologies for the long email. Appreciate your time and hope someone can help.

Need help in filling the online form for spouse visa. Some questions are quite tricky and thought some of the experienced people here can help rescue me. And need help regarding the evidences that need to be submitted.

I am a UK Citizen getting married to an Indian Citizen on 27th September and we are planning to book a visa appointment on 4th October in Hyderabad, India. I will be in India from 23rd September until 15th October. Based on this information can you please help me with the below questions? Some questions sound silly and I thought it's better to hear from experienced people before I mark them. Hope you understand.

Online Form Filling:

Under 'Family Details' section:

Q. Will your spouse/partner be travelling with you?

As mentioned above, I would be travelling back on 15th October and my spouse will be travelling later once she gets her visa. I assume the answer for this question is 'No'. Can you please confirm?

Q. Does your spouse / partner currently live with you?

I will be with my spouse at the point of application. Should we say 'Yes' to this? Somehow I believe the answer should be 'No' to stay inline with the below question.

Under 'Sponsor Details' section:

Q. Is your sponsor currently living in the UK?

I will in India at the point of application but I think for this question the answer should be 'Yes'. Can you please confirm?

Q. Will your sponsor be travelling with you to the UK?

Similar to the above question, I would be travelling back on 15th October and my spouse will be travelling later once she gets her visa. I assume the answer for this question is 'No'. Can you please confirm?

Evidences:

Hope someone can confirm whether the below evidences will be sufficient.

Accomodation:
I have recently moved into a one bed flat where am the sole occupant and my spouse will join later. Tenancy agreement mentions my name as the tenant and my spouse's name as permitted occupier. I have electronically signed the tenancy agreement and hence asked the estate agency to stamp them saying true copy. Do you think this is sufficient proof for accomodation? The agreement doesn't say that it is a
one bed flat.

English language assessment:
I am going to submit UK NARIC English Language Assessment and Comparability Assessment. Hope this is sufficient

Subsisting Relationship:
Marriage Registration Certificate
Marriage Photos and Invitation
Flight tickets showing that we have met before marriage and for marriage
Emails/Calls showing communication before marriage
This will be second marriage for both of us. I haven't seen any guidance asking for documents. Any documentation you suggest?

Financial Requirement:
I am a Director of my Limited Company and have followed section 9.8.1 in Appendix FM Section 1.7. Any thing you suggest on top of this?

I am also planning to attach a photocopy of my passport photo page and pictures of spouse as per visa guidance. Do I need to get the passport copy certified as a true copy?

Finally any documents I am missing or you suggest should be included?

And regarding submitting documents at VFS India centers, I have read conversations on immigrationboards saying that you cannot do it at VFS and have to do it on your own. I have called UKVI 30 mins ago and they have said that there is an option to post documents from VFS itself. Can someone please confirm as I have read on immigrationboards that UKVI says something and you end up hearing exactly opposite at VFS.

Thanks again for you time.

Though there is no specific documents mentioned, would be better to include recent utility bill and Council Tax receipts.

Also need to include original degree cert and letter from uni stating that the degree was taught in English

I am not sure on the last statement above. There are specific questions in the appendix asking about previous marriage so I assume some evidence needs to be provided.
I will let others answer this point, else ask it in a separate thread

Financial Requirement:
I am a Director of my Limited Company and have followed section 9.8.1 in Appendix FM Section 1.7. Any thing you suggest on top of this?
Can't confirm as you have not specified what documents you have submitted

I am also planning to attach a photocopy of my passport photo page and pictures of spouse as per visa guidance. Do I need to get the passport copy certified as a true copy?
Certified copy is not a requirement, though people often do it

Finally any documents I am missing or you suggest should be included?
TB Test result

VFS provides couriering service at extra cost but only in some cities. Refer to their site under User Pay services.

Hi,

We have applied for spouse visa on 3rd of Oct and fingers crossed now.

Can someone plz validate the documents submitted for subsisting relationship and the questions (highlighted in bold) against some of the documents submitted? Thank you.

To give some context, ours' is an arranged marriage. Relationship started on 5th of May and we got married on 27th Sep. We have met in May and July before marriage and in Sep/Oct for marriage and have been constantly in touch through various channels.

Following documents have been submitted:
1. Marriage Registration Certificate
2. 3 Marriage Photos and Invitation
3. Flight tickets showing that we have met before marriage and for marriage. Will flight tickets suffice or do we need to submit boarding passes? I am not sure whether I have all the boarding passes.
4. Email communication starting from end of July to end of Sep (till marriage)
5. Sample whatapp call log starting from second week of May till end of Sep (till marriage)
6. Rebtel call log started from end of June to mid Sep. We talk like 5/6 times a day and this call log was stretching to 30+ pages. Do you suggest to submit rebtel callogs to show that we have been in touch from start of May to end of June or do you think whatsapp call logs should suffice?
7. Original Decree Absolute copies - Mine from the UK and Spouse's from India. In the decree absolute copy of spouse, only initial was mentioned for her last name. For e.g. John Smith was mentioned as John S. Do you see this as an issue?

Thanks a lot for you time!!!

Good Morning Everyone,

Status of our application has moved to 'Being considered and awaiting a decision'. So any help on the above is much appreciated.

In light of the above do you see any point in sending additional documents?

Thanks for help!

you definitely need to provide more photos of your wedding and photos of you two together and with family (since its an arranged marriage) before/after wedding. If you have boarding passes then you should have sent it, if they are not available then question becomes irrelevant

4. Email communication starting from end of July to end of Sep (till marriage)
5. Sample whatapp call log starting from second week of May till end of Sep (till marriage)

since application and documents have already been submitted, You can't really do much about it and if it's a standard way of Indian authorities to issue divorce decree then ECO would be familiar with this way of mentioning name.

I'm not sure of UKVI policy if accepting and considering document submitted later without them asking for it but you should send it before they make a decision

Thanks a lot for you time!!!

Many thanks for your response Metanoia.

Re communication, don't you think points 4, 5 and 6 put together is sufficient to prove that we have been in touch with each other? Especially as mentioned in point 6, we have been talking to each other 5/6 times a day.

Re photos, we haven't taken photos when we met before marriage. In May, we were still talking and not clear on taking the final step towards marriage and in July we have decided and taken just one picture. I should have explained this in covering letter and hope this will not lead to rejection. And the three photos we submitted are one with us two and one with each family.
