Post by umarraza31 » Sat Sep 16, 2017 6:12 pm

Hi, is anyone can help
i have a son came from back home and stayed here with me over 7 years now, my other child will be complete 7 years in uk in few months time.
i came on a student visa and my family was student dependent visa.
my both parents are British national (grandparents of my child),
i have completed 9 year in uk legally, at the moment i am in court on basis drivetive residence application rejected based of my mum carer.

can i apply for 7-year visa
shell i only apply for my son or whole family together
shell i wait for the other child to complete 7 years and then apply together
which form needs to be filled for this application and what evidences required

thanks

Search the forum, this comes up often but the jist is the 7 year 'rule' is now the best interests of child 'rule' and the UKVI sees that as meaning kids are adaptable, and can relocate back.

How old is the child that you brought into the country now, the other child you are referring to, was he/she born in the uk? If you want to apply, it's best you apply for all the family. However chances are the application will be refused as they may say you can continue your life outside the uk. If you are given in country right of appeal, there is a high chance of success.
