Emails from HO on Spouse settlement visa

Post by trsiam88 » Thu Sep 21, 2017 11:54 am

Hi All,

I know I posted this in another topic but I didnt quite so get a response so I thought best to create a new topic, I have received 2 emails from the HO for my wife's spouse visa application as below:

First at 13.52 -
Asking for more documentation as follows -
1) From 23 April 2015, UKVI required applicants to submit results from an “IELTS for UKVI” test that was completed at an IELTS test centre authorised by UKVI to run IELTS tests for UK visa and immigration purposes. You must confirm at the time of registration that you wish to use your test result for these purposes. The IELTS test result you have provided is not recognised when attempting to verify your results on the UKVI IELTS website. I am therefore satisfied that the test certificate you have provided is not an “IELTS for UKVI” test. Please provide a certificafe to confirm that you have passed an “IELTS for UKVI” test.
Now the issue here was that my wife had previously done an IELTs Academic test for a university application and I assumed this was applicable for a settlement app too but I found out it was not after I had submitted the online application, so instead we went down the UK NARIC route and got 2 certificates of english language and comparability from UK NARIC and submitted those along with the IELTs certificate in the supporting documents.....I had mentioned in my covering letter that we have used UK NARIC but in the application I had previously mentioned IELTs to satisfy the english language requirement.

I am sure they have ignored the UK NARIC letters within the application pack so I have emailed them back with the UK NARIC certificates along with the degree and transcript that was used to get the UK NARIC certificates, waiting to see how this shapes up!

Second email at 13.58 (6 minutes later) -
Stating not straight forward as below -
Unfortunately, the processing of your application has not been straightforward and we will be unable to decide your application within our customer service targets. We are continuing to work on your application and aim to make a decision as soon as possible.

So I have responded to the first email, however I am wondering if the second email for case not straight forward was triggered because of the first email or would it be a different reason?! What are the usual reasons for getting a case not straightforward email?

Appreciate all the help I am getting on this forum from the members and the moderators!

You should have corrected the form printout by hand with an explanation in your cover letter and not sent the IELTS certificate.

But that's done, now you can try to get the acknowledgement of the email you sent with Naric certificate. Considering the timing of both emails these should be related but you can never be sure until you'll have the decision or if they'll get in touch with any other query.

All you can do now is wait and try not to worry about it.
Biometrics Karachi 04/08/17
Decision received 11/10 (Visa refused on subsisting relationship)
Acknowledgment 18/12/17
Deadline 02/04/18
Decision withdrawn 26/02/18
Decision overturned 29/03/18
PP submitted 3/4/18
Visa granted 9/4/18

I did attach quite a lengthy cover letter with the whole application and also explained the IELTs situation and asked them to take the UK NARIC letters instead for Knowledge of English Language.

But I guess when the supporting documents were returned, the IELTS certificate was in the beginning along with the TB test and application and the UK NARIC letters were right at the bottom, almost mixed in with the additional documents (pictures, whatsapp chat etc), so I can assume the officer just missed this and has also not read the covering letter!

How do I go about getting an acknowledgement of the email!?

If you have received the documents from Sheffield, You should resend the Naric certificate, old cover letter highlighting your explanation about the situation along with a new cover letter about the emails you received from UKVI. Also try to resend your reply to UKVI asking for acknowledgement of receiving the Naric certificate.

That's what people have done in similar situations where they were asked for a missing document.

They should have seen the certificate in first place but obviously it's our responsibility that see all the relevant documents before making a decision.

Hi guys,

I have sent my wife's UK NARIC certificates in an email last week to the email address provided by HO, was just wondering if it is worth calling up the (shambles) UKVI helpline to ask if they have acknowledged the documents that I have sent or not? Would they know about this?

Hi guys,

Sorry to keep bringing this topic up, but we are thinking that if my wife takes an IELTS for UKVI at the next sitting which is on the 12th of Sept, would it still be ok for me to send the certificate to them once I receive it after the exam (which I would imagine be a week after)?

Would they accept further additional documents even though I have re-sent them the NARIC certificates?

I would do the same if I were in your place. It's about strengthening your case. Hopefully they'll accept it.
