My husband's second marriage

Post by Londra » Mon Sep 25, 2017 10:43 pm

Evening,

Unfortunately this is what has happened to me.
I married my husband in November 2013. He was illegal at the time. I am a EEA exercising treaty rights in the UK.
He has been abusive throughout the course of our relationship and marriage. I thought he was genuine but had mental health issues. So I was supportive and tried my best to make the marriage work.
Couple of times he got violent too but I couldn't bring myself to call the police.
In August while in Egypt on holiday to see his family he got married to his cousin behind my back. Until the last day he told me he loved me.
I found out he got engaged in September 2016 to his cousin.
He made up excuses put through hell even asked me for money lied so much and deceived me.
I informed the police the home office and I am filing for divorce. He is still in Egypt and will soon receive the divorce papers. The home office has told me that they will take into consideration and investigate but that they can't disclose any information with me any longer since I informed them of the breakdown of the relationship.
I would like to know if he will be deported in case he came back. I have been told that he will be stopped and detained and also arrested for abuse but I don't want him here in the UK anymore.
He used me and abused had no respect and has done so much psychological damage to me that I want justice.
Could anyone tell me please ?
Thanks

No.

Unlike the spouse of a British citizen, who can be refused entry into the UK after the relationship has ceased to subsist, your husband, as the spouse of an EEA citizen, has the right to enter the UK as long as he is married to you (i.e. till the date of the decree absolute) and you are in the UK exercising treaty rights. Even after that date, if both you and he were resident in the UK on the date of the decree absolute, he would retain the right of residence till he acquires PR in his own right.

These are his rights under EU law.

Your only consolation will be that in order for him to sponsor his second wife to the UK, he will need to remarry her after the decree absolute as the second marriage is not valid for the purposes of UK immigration law. Also, he will only be able to sponsor the second wife after he acquires PR (most likely, on the fifth anniversary of your marriage) and then too only under the more onerous UK Immigration Rules, which requires him to earn £18,600 p.a. or more.

This is really disconcerting !!
I mean he obviously used me and also he was abusive and I have pressed charges for Domestic Violence and Abuse.
He got engaged before having been married to me 3 years and had I known that I would have left him.
He has manipulated me and still he will be able to continue residing ??
What about justice for me as a victim of such an atrocious behavior? he married and I have proof of it.
Where can I read about this specific law ? I mean to understand how it works and maybe it is different for each case? Would it be taken into account how he has deceived me?
Thanks
