Hi,
My Employer Email domain account has been changed in 2016 April. They forgot to update the contact Email ID on SMS account as a result we have't get notified from the Home office that the Licence Expiry due date and no one was aware of it in the HR department.
After 6 Months I have received a Curtailment Letter from Home Office stating that Your Employer Licence has been expired It appears that you have not made any application since Feb 2017. They have given me 60 days time to make a new application.
After i submit the letter my HR gone on to the SMS system to check the status but it has been blocked and no longer have access to the system.
When my HR contacted HO and they have advised if you haven't renewed the licence in time by deliberately or by mistake then you can not get access and advised my employer to register like any other new company. The licence application has been processed in 14 days. Now We have got the New Licence.
They have completed the RLMT and advertised the job for 4 weeks. My Employer will soon assign a COS. I have few questions below:
My Initial Tier2 General Leave to remain was granted on 02 September 2013.
1. When Assigning the new COS is this COS is Exempted from the Immigration Skill Charges (ISC)?
2. My Employer has registered again and got the new licence that means Assigning COS application is Tier 2 Change of Employment?
3. I have been Granted Leave to remain tier 2 visa on 2013 am i Exempted from the Experienced Rate 30,000 salary requirement implemented in 2017?
4. When i got the Curtailment letter i have submitted the Letter to HR and stopped working. Both me and my employer was not aware of the Expiry date i had worked for 6 months since the expiry date to the Curtailment letter date i.e., from feb 2017 to aug 2017. Does this effect my visa application?
