Urgent advice will be greatly appreciated here.
My friend applied to the First Tier Tribunal for permission to appeal to Upper Tribunal following a refusal of her appeal in Nov 2015 and had been waiting for a response till now. He has however received a letter in the post on Tuesday from Hone Office stating that they are looking to revoke his Driving Licence as he no longer has a right to be in the country as he has exhausted all appeal rights.
He responded advising that he was waiting for permission from the FTT to appeal to the UTT but the home office wrote back to say all appeal rights were exhausted in July 2017 following a refusal by the FTT to appeal to the UTT.
He then called the FTT to check the status of his appeal and was advised that a decision was indeed made in June 2017 refusing permission to appeal to the UTT and a letter was sent in June.
My friend never received this decision letter. He has been advised by the FTT to request a copy of the decision in writing.
My question is where does this leave him?
He currently reports monthly to sign on the instructions of the Home Office and has been doing this since his application for ILR in 2014 was refused.
Can he now be deported without notice?
What can be done at this time?
Advice will be greatly appreciated.
Thanks.
