Complex situation

Post by redsaintt » Fri Sep 29, 2017 5:16 am

Hi
I am about to apply citizenship but I had a serious issue with my 10 year history.
I landed in uk 2007 as a student, stop by immigration in 2008 April coming back from my country and she cancel my work permission is this thing effect.
2nd question I married to eea 15 December 2009
My visa expired on 23 December, I couldnt prepare my document cause of Christmas holidays, I think in February or March I submitted my application for recidency which I got it in Oct for 5 years. Now that specific gap counts when I apply for citizenship or not.
Thank you

You will need to have a permanent residence PR for 12 months before you can apply for citizenship.

Can you expand on this? Were you a student or were you on a work visa? Were you working more than permitted hours on a student visa? Were you allowed into the UK? If so, on what visa?

What was your immigration status in the UK between April 2008 and December 2009?

Provided you were legally (not just religiously) married to a non-British EEA national, you would have acquired the legal right to reside in the UK by your marriage on 15th December 2009.
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.

You have not answered the question on whether you were working more than 20 hrs on a student visa. Is this why your visa was withdrawn? If so, you may have been in breach of immigration law which will affect your good character requirement for naturalization

3 months gap should not affect your continous residence.
