Issue regarding "Have you been refused a visa in any country" in ILR form

Post by redcamp23 » Sat Sep 30, 2017 2:42 pm

Hi all,

Im jusy filling my ILR application for an application soon and on the question.

I need some help regarding this question below.

Have you been refused a visa to any country including the UK ?

A month ago I had applied for a Schengen visa (###) which resulted in the embassy requesting additional documents by post to be sent to embassy. I did sent documents but they requsted a few more which I was struggling to provide due to a time constraint.

Unfortunately my travel flight date was in just 4 days time and they still had an issue to give me a verdict.

They sent me an email again with a stamped letter not in English just before 4 days of my travel date explaining that my UK Visa was expiring in 90 days soon and more additional documents are required still to decide on the application.

I need to respond them soon in the next 7 days the reciept of their letter to bring the case uptodate.

I called up the consular office straightaway and explained them more correspondence now would add up more days and then I if Im to amend the travel plan, I wouldn't be able to satisfy the 90 days remaining on my UK visa on departure of schengen area.

The consular person then suggested that would I then like to withdraw the application and then my passport would be sent back for collection straightaway.

She even said on phone that there would be no refusal on the file etc. She then quickly sent me a withdrawal letter to be signed and sent for which I did straightaway.

Collected my passport next day with no refusal letter enclosed or any stamp on passport.

Technically I withdrew my application and since I had no official refusal letter in English enclosed with my passport.

I'm answering NO on the below ILR question
Have you been refused a visa to any country including the UK ?

Can someone clear this doubt for me please ?

I know this forum is so helpful in complicated issuesso hopefully I get a reply soon.

Thanks.

The answer is 'No' as you withdrew the application.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
