Hi all...
I need help.
If im applying for indefinite leave to remain in the UK as a person who was refused asylum after 6 years -
1. What form do i complete?
2. What supporting documents can I submit?
3. Can I use the premium service?
4. Do I need english test or life in the uk.
5. Do I pay the health surcharge fee?

I was granted my first 3yrs in November 2011

1. I think it is form DL as you have had a failed asylum before being granted Dlr.

2. Usually they will look at the circumstances prevailing at the time of original grant of DLR, and any other evidence.

If the grant was based on family life, then things like utility bills, letters, bank account statements as well as proof of income and maybe letters of support would and the fact that the family life is still intact (still married to the same spouse) and there haven't been changes since been granted. But as you will have to see on your documents what you were given DLR for.

Also note, make sure you complete 6 years of DLR before applying(minus 28 days as that would count as well.

3. As far as my understanding is, premium service can only be used with these application forms. Click here . Again as yiu were granted DLR based on a previous failed asylum application, I think you might not be able to do Premium service as your case might also be complicated and might need more time to decide.

4. For those on DLR there are no language requirements.

5. No as you will be applicable to apply for settlement (ILR) after accrued 6 years. There will be no NHS surcharge.

Again the IHS number is only applicable for non settlement applications. For settlement applicationa you do not need.

I would leave it blank, the application it self can be used for further leave to remain (extend current visa) in which case you will need to pay the NHS surcharge and will get a Ihs number.

But if it is for settlement, you do not need to pay for the NHS surcharge.

As you are applying for settlement(ILR) after 6 years of DLR you do not need it. DLR is granted outside the immigration rules and therefore it might not be covered in the general visas and applications under the immigration rules.

Hi. I came to uk in 2007 and then i applied 4 asylum 2010. I was pregnant and could not go back because of family threats. Asylum was refused appeal was eefused. Then on further submission i produced my son british passport. Home office gave me 3 years discretionry leave which was extended in 2014 then i travel for 3 weeks to back home . My visa documents says determination of asylum claim . Now after 6 years i have to apply for ILR. My visit to my home country will effect my ILR. Plz do suggest me i m very stressed. I applied on 10 years route on premium service but home office says there is 90 days gap after appeal and getting visa in 2011. Need to apply on discretion leave base. Plz do reply thnx.

Not to be rude, but you already have a thread you started on this very topic Click here.

Please continue on that as it will keep your questions and queries in your thread that you already started. It is highly unfair to the original OP of this thread when the answers they are looking for the questions asked might be putting people off from answering because of this. Not only that but you seem to have varied your statement from your original thread when you first posted in regards to the situation, i.e: from mental stress to threats from your home country.
