Switching from Tier 4 to Tier 2 with a scholarship

Post by ormee » Sun Oct 01, 2017 6:53 pm

Hi,
Does anyone know or has tried to apply for a Tier 2 visa (within the UK) being on Tier 4 without providing a letter of agreement from an organisation who gave a full scholarship?

Yes, you can apply for T2 General without a employment agreement.

Note:- You need to submitted original sponsorship letter given to you by employer.

Scholarships can be provided by other bodies, not just an employer. There are specific requirements for Tier 2 applicants who were sponsored for their recent studies by a government or international scholarship agency. See paragraph 245HD(vi) of the immigration rules:

If the applicant:
(1) is currently being sponsored by a government or international scholarship agency, or
(2) was being sponsored by a government or international scholarship agency, and that sponsorship came to an end 12 months ago or less, the applicant must provide the unconditional written consent of the sponsoring Government or agency to the application and must provide the specified documents as set out in paragraph 245A above, to show that this requirement has been met.

Paragraph 245A says the specified documents are

original letters, on the official letter-headed paper or stationery of the organisation(s), bearing the official stamp of that organisation and issued by an authorised official of that organisation. The documents must confirm that the organisation gives the applicant unconditional consent to remain in or re-enter the UK for an unlimited time.

It is also explained in the Tier 2 Policy Guidance, paragraphs 17. 201 and 202.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.
