Hi there. Can anyone advise....my civil partner has just applied for his ILR as his 5 years is up around the 14th November. We have tried to upgrade to fast track from standard and haven’t heard anything and are being told the usual way of applying can take up to six months. Does anyone know what happens if his visa expires and we haven’t heard anything from either fast track or the standard process? Is there an option to extend his visa to allow him to continue living and working here in the U.K. or does he have to go home back to USA.? Cannot find much online and panicking as his current visa has almost expired. Thanks, Matt

His legal right to remain will continue while his visa application is being decided.

That’s a relief. Thank you. Would a current employer accept this as proof of being able to live and work here in the U.K.? We can show them we’ve applied as we have a case number. Thanks

Yes, but you can also ask them to use the Employer Checking Service.
