Hi everyone,

I need some advise on extending my current Tier 4 leave which was granted in June 2015 for an PhD via MPhil course. My question will be divided in two parts as follows:

1) Idid BSc (2010-2013),
opted for MSc but didn't get enough grades to be awared an MSc so got PGDip instead (2013-Jan'2015) and finally PhD (via MPhil) route; Tier 4 granted from June'15 - Jan'18.

If I now apply for extension of Tier 4 will the cap be applicable to me? From other posts I have read courses on Page 91 of policy guidance and have not taken any of them. But the history remains as above.

2) Since my current or latest Tier 4 leave was before 6th April 2016, and was granted under an MPhil title, I need to get a new Tier 4 leave as I am now a PhD year 3 and not an MPhil. SO, do I need to return to my home country for the same or can I make an application within the UK. - My understanding of guidance says if it is an integrated course or MPhil to Phd transfer, one does not have to return to home country for an extension or renewal of Tier 4 visa

Any advice will be greatly appreciated.

The cap applies if you have completed an MPhil that lasted 13 months or less. See the Tier 4 Policy Guidance paragraph 117 and Annex 4.

No, but this needs to be discussed and properly ascertained with your Tier 4 sponsor.

The best thing to do is to ask your tier 4 sponsor who will ask from the compliance team or the UKVI premium manager to check your immigration history and check if you can study further or not.
