eu permanent residence after five years of exercising treaty rights

Post by Georgouslad » Sun Oct 08, 2017 8:39 pm

hi folks,

i am an eu national and have been working in the uk for five years now. i am in the process of applying for permanent residence but i have a query that needs to be clarified.
so i changed employers a year ago, basically there was a gap of one month between my employments BUT when i left my job on 11th december, 2015, i already had a job offer from my present employer with a start date of 11th january, 2016. so i did not register as a job seeker for this one month. i have been told by an immigration lawyer that i have a gap of one month in which i was not exercising treaty rights and hence my application for pr will be rejected. is this an accurate advice.

thanks

I don't see an issue with the one month gap, and leaving a job with a new job lined up one could easily argue that's part of the the job seeking process. As long as you can provide the paperwork. Why a lawyer would state that one month gap (even a real one) would lead to rejection is beyond me.
This is just my opinion as a member of this forum and does not constitute immigration advice.

he said i did not register with the job centre as a job seeker.
but the thing is i got the new job offer while i was working for my last employer, just the start date was delayed.so when i left that employment, i already had secured a new one and why would i need to register as a job seeker as i found a job and just waited for my start date?
should i apply for pr ignoring this one month gap?

Hi. This is not a problem. You already had a job offer. Just include the offer letter with your application.

Hello. I'm in exactly the same situation as you but with a two month gap instead of one. What did you do in the end?
