British citizen married to a Afghani guy

Post by Taniaparwany1 » Tue Oct 10, 2017 3:23 pm

Hi my name is Tania. I will give you a short explanation of what my situation is. I met my husband on 10th April 2014. We were seeing one another for a year. On may 2017 I married my husband in a cultural and religious marriage. My husband has been living in the uk illegally since 2007 - when his asaylum case got refused.
After our marriage in September 2015 my husband went to Dublin to claim asaylum there.
The uk authorities requested for him to be sent back to the Uk on 24/05/2016.
After this I applied for his leave to remain on the basis of a British spouse. During the time of the application we were living with my parents. We actually did get a uk marriage certificate in Sep 2016.
We moved to our own house on the 8th may 2017. We have all the bills and house agreement and pictures and furniture receipts in our names.
We received a letter from the home office where they have refused our application and my husband is to be removed back to Afghanistan.
We went to see new solicitors. During the application time before it was even refused we had sent evidence to the home office to say we have moved out to our own place and we live together.
The home office has ignored our uk marriage certificate and our evidence. They refused our application because they think we are not in a genuine relationship and don not live together. And our lives are not at risk in Afghanistan so either of us can go back to Afghanistan with no obsticles. I am a university student. I came to the uk in 2000 and claimed asylum with my family.
Now I am a British citizen. I have married the love of my life and I am so scared for what will happen to him.
I am 5 weeks pregnant now and we are expecting our first child together.
Our solicitors have sent the decision for a judicial review because the home office has ignored everything we have sent to them.
We are waiting for their decision.
Now we got another letter from home office in Liverpool which is different from the one where we have sent our review for.
Now the home office in Liverpool has refused my husbands claims that his life is in danger and that he is in a genuine relationship with me.
They want to remove him from the uk.
I don't know what to do . Why are the home office not communicating with one another. One office is sending us refusals and the other is asking for more time in deciding in regards to the review.
We have sent them tons of evidence but they just ignore it.
I can't go through this pregnancy without my husband he is my support my everything. I can not go through my labour alone. I need my husband . Our child will need his/ her father.
Can someone please give me some insight on what's going to happen?
Are they going to send my husband back. I am scared of having a miscarriage. I am so happy that I am pregnant . On the other hand I am so stressed and depressed with everything that is going on with my husbands immigration.
Please any advice is appreciated
Tania

Judicial review will buy you a few months and they won't remove him while it's pending.
You need to manage somehow till delivery and once the child is born you Will have a decent chance under family route

Thank you for your reply.
I still have 8 months till I give birth.

If you just starting the jr process then I assume it's going to take not less than 8 month.

did your husband have an interview before the HO make decision and how long the HO take before they make decision of your application?
another question i need to ask is how did you get approval marriage certificate?

i also advice you not worry because they cant remove him while JR is pending, did you inform them that you guys got pregnant bcuz that could eliminate that doubt that they have about Ur marriage

Hi,

We got our marriage certificate firstly by calling the town hall. They booked us a interview with the registra and she asked a few questions about us and how well we know each other. Bcz his case and application was pending and with the HO, we could request to get married in a civil ceremony. After the interview we got a letter from HO saying they wanna investigate our proposal for marriage. This took 70 days we had to wait 70 days before we could get a date for our marriage registration. But during the 70 days the home office didn't write to us to ask for evidence, they didn't call us for an interview. After 70 days period they gave us permission to proceed with the marriage registration. All took 2 months.
My husband applied for his application in May 2016 and he got refused in August 2017.
The home office have now wrote to us saying they need 3 months to reconsider the decision based on judicial review.
