Tier 2 to ILR Query

Hello everyone,

I'm on Tier 2 visa and eligible for ILR in Nov 2018. My history in UK is

Jan 2010 till Nov 2011 - Tier 4 Student (Master Degree)
01-Dec-2011 till 01-Dec-2013 - PSW
26-Nov-2013 till now - Tier 2

While I was in PSW visa, I had a limited company and worked as Contractor. I got my Tier 2 Visa on 26-Nov-2013 and informed my Accountant that I will be moving to a Permanent position from 01-Feb-2014 and either close the company or keep it dormant. Also I asked my accountant whether I can withdraw salary for Dec 2013 and they said yes (Think I dint explain them fully that my PSW visa to work as contractor ended on 26-Nov-2013 and moving to Employer sponsored Tier 2 Visa). So I withdraw salary for Dec 2013

Now I've started collecting the required documents for ILR and found this. Will I be refused ILR since I took salary fro Dec 2013 from my limited company while I was on Tier 2 (but I didn't do any work). Is there a way to address this situation now?

Request Gurus and others to advise.

you need to get your income history from hmrc, and see what does that say.
If it was a limited company and u were the only employee, it is likely, the accountant was not filing the RTI accounts and u could be safe as all he would have done is shown the amount taken as salaries and not really which months salary.
you will not be required to submit your statements from 5 years back, so hopefully should not flag up. IMO

I got my income history from HMRC

It is mentioned as below (sorry for poor formatting)

Employer -- Reference -- Start Date -- End Date -- Pay -- Tax -- TaxCode
ABC -- AB123 -- 06/04/2013 -- 30/12/2013 --XXXX 0000 XXXX

Do you mean that Accountants would be filed as salary for the whole year not for individual month?

I have closed the limited company Nov 2014.

Is it ok to ask the accountant to update and pay any pending tax?

to be honest, i would not be be too much concerned about this.
This much time is needed to stop/close companies and make them dormant anyway.
