ilr complicated

Post by monekpinky » Mon Oct 16, 2017 8:50 pm

i have been staying In UK for since 2008, never went back to home country, India ever, had been in student visa, followed again by the same , then applied for PSW visa, but 2 times got rejected as invalid. Explaination of photo not perfect and some silly reasons. When i received it as invalid i didn't have any visa as i apply on the last day always. Got it anyway and then applied for work permit ad got through, but got it curtailed in between. DIdn't get any letter of curtailment and homeoofice claimed that they had sent it but got it returned. again game me a letter offering 2 months and appplied for Flr (0).But months after homeoffice sent a letter explaining that i didn't turn up for biometric and asked to apply again with the fees too. They took the fees first time itself and kept it with them. i applied again, but the cheque got bounced back because of bank's error, sent letter to home office the very nextday explaining it was a bank error by my solicitor. but a month after biometric invitation letter came through, went for biometric at the first opportunity itself, paid the fees of 993 when they requested. Its all done through the same reliable solicitor firm and they too received any biometric invitation letter the first time nor me which i explained before. now it nearly 10 years i may need to apply for something still to reach the ten year mark legally. The worry is that the solicitor told me that probably a break has happened by this time and he need to refer for all the history to comment further and need to look at my SAR which was dated an year before, anyway before home office gave me an opprtunity to apply for FLR 2nd time. i spent all the time and never went back to india all for this ILR, if this ha[ppenes ehat to do, it will be a heart broken thing for me, because what ever i did was never purposefully did anything to extend in a cunning way

What would be helpful is the grant dates and expiry of visas. With out it, it is kind of hard to determine where a break of continuous stay may have happened. Especially as you state that you applied 2 times and it came back as invalid but then were granted a third attempt??
These are my 'views' and 'opinions'.
If in doubt always seek professional advice, or at least do a search for the relevant information. :P

If i make any mistakes, You are more than welcome to correct me.

ok, the application was on October 2011 and got returned i think in November and january i don't remember about the dates exactly for those 2 applications but the third one was in february 2012, visa granted in 2012 august. i remember the 1st time itself they took the fees and second time, i applied with the fees again and they returned the application, didn't attempt to take the fees. again the curtailment latter was sent in November 2015 according to their claim, but didn't get it and i needed to asked them again through the solicitor, after we came to know about the earlier incident when reviewed the SAR. Applied for Flr in 2016 june and in february 2017 they sent the letter explaining my failure to attend the biometric and asked to apply again which i did and waiting
