Settlement or Further Leave to Remain

Post by Kashif_Hussain » Tue Oct 17, 2017 9:02 am

Hi,

Child has completed 6 years after 2x 3-Year DLR.
Parent has completed 3 years on DLR (3 more years to go for ILR) and now it's time for 2nd extension for parent.

What should be the next course of action?

1. Should child make settlement application SET(O) or apply for another extension with parent and apply for settlement with parent :?:

2. For further leave (extension) what form should the parent use FLR(HRO) or FLR(FP) :?:

Thanks to all in advance.
Kash

Child can apply for settlement, and parent apply for an extension.

Surprised that parent was granted 3 years DLR 3 years ago.

Anyway parent can apply for extension and child can apply for settlement.

Many thanks Obie

So children can apply for settlement even though parent is still on DLR.

Decision letter says:
"A person will not become eligible for settlement until they have completed 6 years of Discretionary Leave."

"Application form FLR(O) must be used if you are applying for an extension of Discretionary Leave (DL) where you have previously been granted a period of DL, but have not previously been refused or granted less than four year Exceptional Leave"

Thanks again.

Previously granted 3-Year discretionary leave to remain.
What form should we use to extend our leave? FLR(HRO) or FLR(FP)?

What documents to submit with SET(O) settlement after 6 years of DL for a child under 10?

Home Office no more granting discretionary leave so can anyone upload wording of decision letter after getting 2.5 year leave to remain under family & private (5 or 10 year route to settlement)

Please help, thanks in advance.
