T2 Extension Salary help

Hi Guys
I would appreciate if someone with similar experience or knowledge help me with supporting links.

I realised that the T2 extension should use the 'experienced' salary however my employer is not ready for that since the salary threshold for experienced is way above than what he could afford.
He is only ready for minimum pay rise.
Here is the case
SOC Code - 2421
Experienced salary : 29k based on Annual Survey of Hours and Earnings 2016(39 hours)
Salary required : 30k or the experienced salary which ever is higher.

I understand that my contract should be at least 30 hours,

so if i get a COS for 30 hours can my salary be
30,000/39= 576p/w
576/39=14.79p/hrs
14.79p/hr x 30 = 443 p/w
443p/w *52= 23076???per annum

Unfortunately NO.
You can use pro rata salary but under current immigration rules, you need to meet the experienced salary rate as well as a minimum of £30,000 per year(whatever is higher, in NO case you need to earn less than £30,000 per year)
I will give an example.
For example,
- if experienced salary rate is £27,000 per year for your SOC codes, your current salary is £29,000 per year, though you are earning more than the experienced salary required,you will still not meet the salary requirement and your visa will be rejected as you haven't met the £30,000 minimum salary requirement for extension,
- if experienced salary rate is £35,000 per year for your SOC codes, your current salary is £34,000 per year, though you are earning more than £30,000 minimum salary requirement for extension you will still not meet the salary requirement and your visa will be rejected as you haven't met the experienced salary of £35,000 required.

You can use pro rata salary based on 30 hours/week mentioned BUT it still need to be more than £30,000 which is minimum earning requirement for Tier2 extension.

Thanks for providing more info,
In that case if the first CoS (with any employer) was assigned to you before 24 November 2016, then,

- £30k minimum salary rate does not apply; BUT
-The applicable SOC Code ‘experienced’ rate does apply; AND
- For pro-rata positions - must be paid at or above £20,800

So in my case will I be right to accept following salary in 30 hours and make an application for extension.

Should be fine. Make sure the sponsor includes these pro rata hours while generating COS.
Also the hours shouldn't be less than 30 hours/week.

It looks like 30 hours min contract required is only for the jobs in shortage occupation list.(Page 28)

I don't think its confusing at all. Where do you see that you could only do 30 hrs/week for only jobs in shortage occupation list?
All it says is "105.Your contracted working hours must be at least 30 hours a week."
meaning that you need to do at-least 30 hrs a week if your job is in shortage occupation list .

I believe you are not going to do less than 30 hrs/week job so what are you worrying about?

Because my job code is not Shortage Occupation List, can I still do 30 hours only?
