Dlr on refused asylum 2017 apply ilr

Dlr on refused asylum 2017 apply ilr

Hi every one. I came to UK in 2007 as student had boy friend got pregrant then he left me I claimed for asylum while having valid visa. Asylum refused appeal was refused. I had severe mental health probelm then we gave application for further submission which was my son British passport and grant visa on September 2011. Which was extended again till march 2018. After extension went back home for 3 weeks at the airport they ask me to wait then immigration officer took 40 mind by saying it's routine work .I need to apply after y years for ILR. My son is living with me I m sole parent and single mom . My question is visiting to country from where I claim asylum will effect my iLR. If yes then what can I do.? I m worried and stressed. Plz do reply this

Hi,

Firstly your asylum was refused, and the appeal process was refused based on the refused asylum application. I don't think that can have an effect on your application for ILR now, but it may depending how UKVI look at it, I say that as you came to the UK as a student and not a refugee or someone fleeing persecution seeking protection in the UK as that what asylum is for. Sounds like UKVI picked up on that and may have been right to refuse you on that basis.

Also the fact you went back to your home country after your second extension of the current leave to remain will raise some questions, but I think when you apply for BC it might, not so much for ILR I think.

These may be more of an issue when applying for BC in my opinion, as they look at the past 10 years.

It sounds like you may have been granted DLR based on your family life as single parent as you are the only carer to a UK citizen under 18 when you made a further application in Sept 2011.

Again what was expiry date of visa when you made another application in September 2011?
And what application type did you make? Was it for family life as a parent route?

Hi. When i applied for 2nd extension in 2014. I just fill form DL home ofgice suggest me and there was no fee. Then they ask me send me some paper work u r sole parent i send just few hospital letter they grant visa till 03/ 18 .its 6 years in September. I m here for 10 years in uk too. But my continuty is broken after asylum appeal refused then apply for further submission its took 90 days untill i grant visa. Now i m thinking for ILR but strees about the visit which i had in 2015

Hi Dear,
Its nothing to do with discontinuity because your asylum was refused previously you are under 6 years rule and you got granted before july 2012 as you said you did fresh submission before your first grant. you are eligible to apply for ILR after 6 years of your discretionary leave.
If you are going to apply ILR with filling DL form then yes there is section about visit abroad you have to explain them.

Hi. Because of 90 days i cant apply on 10 year route. But i m worried i travelled back home how much it will effect my ILR. And what worst hime office can do. My son 7 now living with me . And i m single mom . Bit worries for ILR

one of my friend he is on 10 years rule he got granted 2.5 years discretionary leave (2nd time) he did go back to his country during his first period of leave and been stopped at airport for routine check he never had problem to get his 2nd extension. His asylum was refused previously. He has no dependent.
every person have individual circumstances i think better to seek advice from any qualify solicitor or adviser.

Again what was the last leave to remain expiry date before you made an application using form DL in September 2011. So, the visa expiry date held before and during the application for asylum.

Sorry maybe I'm misunderstanding, what was the expiry of previous visa, if you were granted/given leave to remain on 12/09/2011?

September 2007 cane on student visa then got extention in december 2008 student visa last visa was student which supposed to expire october 2010. But in may 14 / 2010 i claimed asylum. Which was refused and appeal was refused. Then further submission application on fresh evidence was given to same case worker. It was my son british passport then i was granted discretionay leave to remain on 12/2011. T
