Naturalisation & non-EEA Family Members

Hello,

I've been granted British citizenship earlier this year, I am also EEA national. I'm married to a non EEA citizen and wonder how the fact of me being British would affect my Colombian wife.

We got married about 4.5 years ago and she came straight after to live with me in UK. At the moment she's got about 1 year remaining of 'EEA family member' visa which entitles her to reside here in UK just like myself but as it's not the permanent permit I cannot apply for her naturalisation.

Any ideas how would that affect us / what needs to be done to make sure she's here legally (nothing really changed apart from me stopping excersing my EU treaty rights?)

Your naturalisation is likely to cause problem to her acquiring Permanent Right of Residence.

I wonder why you did not seek advise before naturalizing.

My bad I didn't search advice - but it's too late now to say / wonder why etc...

I guess I'll need to get it sorted asap if her right changed significantly.

Well under the current rules she has no rights at all.

One can only hope that the court case coming up next month will be decided in favour of people like your wife.

If the Home Office has his way, and under the current rules, your partner has no rights in the UK as things stand.

That's straight to the point and slightly scary...

We are both working, my step daughter goes to secondary school here, bought a house a year ago.

What would you advise please, sit tight and wait for the court ruling or try to change her visa before it's too late?
