Canadian in UK on Tier 5 with baby now

Post by Henners12 » Tue Oct 24, 2017 9:29 am

Hi all,

I was hoping someone could help me. I’m a british citizen and my Canadian partner is in UK on a tier 5 youth mobility visa. She fell pregnant soon after arriving, and we now have a baby girl born 2 weeks ago. We’re not married (we are engaged intending to marry), so I wanted to know what our options are as she isn’t supposed to have dependants on her visa and we’re not applicable for spousal visa yet. Our child is British, but they surely wouldn’t look to deport the mother of the child - as that’s a human rights breach?!

We have tickets to go back to Canada on holiday at Christmas and intend to marry there - we’re worried about coming back into the country with our child even though I’m british and she has a visa - is it something to worry about? What will likely happen?

Any help would be much appreciated!

Henry
