Regaining Permanent Residence in the UK

Post by Katrina2014 » Wed Oct 25, 2017 9:33 pm

Hello,
I am a EEA citizen wondering if it's possible to regain my permanent residence in the UK. (Pls feel free to re-direct my question if it's in the wrong place.)
The situation is following. I have lived in the UK since June 2006 until May 2013. In February 2012 I got my permanent residence, but in May 2013 had to move to Colombia because of my boyfriend (who I'd met in the UK, but his student visa got expired and he had to go back). Here we got married and our son was born. Since that time I went to the UK twice to visit my parents (British and EEA citizens) and my brother (EEA citizen). I've always wanted to come back and finally persuaded my husband, so we are coming back in February-March 2018, but might be a bit earlier. I know now that after 2 years of absence the permanent residence is lost, but I also heard that there might be some exceptions, therefore am wondering if I have any chance to regain it once I start working in the UK again? If yes, under which conditions it might be possible and where to look for this information (couldn't find anything on the official government site)? (Don't know if it matters, but I also had a stroke in February 2014 for unknown reason.)
And in case I have no chance to regain my Permanent Residence, do I have to start completely from zero (registering at the Home Office, getting Residence Permit and waiting for 5 years) or some steps might be skipped?
Thank you in advance,
Katerina

Remember the expected date when the UK will leave the EU is the end of March 2019.
Until then everything should be as "normal", i.e. Family Permit, RC - but you won't be able to re-gain your PR until the exit date, even if there are exceptions but I am not aware of those. Home Office will be starting to register EU citizens in 2018 so you will be affected by that process, but nobody yet knows how that will look.
This is just my opinion as a member of this forum and does not constitute immigration advice.
Please do not send me private messages asking for advice.

Thank you very much!:)
And have you heard any news about the cut-off date? (All I know is that it's supposed to be any date between March 2017 and the date the UK will exit EU, but nothing else more definite..) The reason I wonder is whether it would make a significant difference if we travel to the UK, lets say, in January (to increase our chances of arriving before the cut-off date) or March 2018? Or meanwhile it's all just guessing before the official information is announced?
