How to request my passport back?

Good Day!

I would like to ask how can i get back my passport.

May 2016 i applied for a permanent resident permit as a wife of an eea national (portuguese) but was refused coz my husband is also a brirish citizen, home office returned all my documents except for my passport.

With the help of a solicitor i applied for a flr (fp) and luckily it was granted but when the home office returned my documents and the brp card my passport is not included.

My solicitor told me to wait for 3 weeks the home office will send it but its been 3 months now since i received my brp card i havent received my passport,unfortunately my solicitor is uncooperate with me when it comes to request to get back my passport they keep saying that they already send a letter to request for the return of my passport whenever i ask for a proof they dont have something to show and later on i found out that they havent send anything to request my passport back.

Can any one help me what to do to get back my passport and how long it takes?
