Post by bably » Sat Oct 28, 2017 11:04 am

Hi,

I am a british citizen with british child.my wife is on last 2 years of the 5 year ILR route.
I have now been offered contract which may be 1 to 2 years in ireland.
planning to return every weekends to UK which will be our main residence as my wife and kid stays in uk.
will this affect my wife ILR application?

thanks

I don't believe it would, as you are travelling due to work reasons. Plus you will have a contract in hand to prove this and your main residence is still the same.

Also, is this Northern Ireland or the Republic of Ireland, as Northern Ireland is part of the UK and I believe it shouldn't really impact her application for ILR.

Again, my understanding is it's not for you to meet the requirements as, as a British citizen you are free from immigration control, but your spouse will be under immigration control and if they were the one travelling and having to move to Ireland (apart from Northern Ireland) I believe it would be a different interpretation of the rules set out before her in order to be eligible to apply for ILR.

Again clarification would be needed. Hope this helps.
These are my 'views' and 'opinions'.
If in doubt always seek professional advice, or at least do a search for the relevant information. :P

The contract is on eire (dublin).

Keep your tax affairs in order too, you'll be tax resident in both countries given what you've said.

Yaa.
I was aware of it and was reading through double taxation to see will there be some sort of relief or will it be fully taxed.

My Main Concern is showing UK income when applying for spouse ILR and also whether HO accepts prrof of cohabitation when i stay 5 out of 7 days in ireland.
since all my wages will be in euros,i am not sure whether homeoffice will accept foreign income when going through ILR.
