Reconsideration letter sent by UKBA

Hi All,

I am dependent holder of Tier 1 and my wife is a main applicant.

we have applied for tier 1 entrepreneur extension and our visa got refused in Aug then we have applied for AR, that also got refused.

So we have decided to launch JR with the help of my solicitor, So solicitor has sent PAP to home office in September.

But we have received the letter from home office saying " we will reconsider your application and will make a decision in three months". So shall we go forward with JR without waiting for their decision?

Reason for our initial refusal:

Not enough evidence submitted for trading even though we have given all the contract details and invoices which we have made for last two years.

Also we have been running our consultancy business in good shape for last two years and made quiet lot of profit and paid more than 6000 pounds as a corporation tax.


In addition, I had been working as a SW Engineer for one of the company as I am the dependent holder of Tier 1.But I stopped working after the AR got refused.

So am I allowed to work now since Home office decided to reconsider our application ?

First off there is no UKBA anymore it is UKVI.
It is correct that you have been refused an extension due to genuineness concerns from HO ?!
Also remember that according to the Civil Procedure Rules a claim for Judicial Review should be made as soon as possible and not later than 3 months from the date of the refusal letter.

Sorry to hear about the refusal.
How come you didn't reapply?

Also, not enough data to show trading? But one isn't required to send contracts and invoices.
Were those the exact words in the letter?

Did you get refused under genuine entrepreneur test or were not awarded points?

What is exact in the refusal letter?
In your thread it seemed not the way the UKVI should send?
