Transitional provisions

Post by Aich03 » Sat Nov 04, 2017 8:47 am

Dear Sir?Madam

I am non-eea national , i have married an EEA national on Nov20 11, i have applied for a residence card on Dec2011 , my application was first refused because i didnt have a valid ID (passport)that was on the 04 OCT 2012, the Home Office then didnt give me the right for an appeal, but i was entitle for Judicial Review , I have made a new passport and i have submitted a fresh application , i have given a priority by the case worker who asked me to put the fresh application in a pink envelope sent by him , i have re-sent my application again with a new passport on 25NOV 2012 ,three weeks later they granted me a Residence card for eea family (5 years).

My wife became british citizen in 2014 and also my all 3 kids , i didnt know that will cause me so much trouble when i will apply for a PR , my questions are :

1-Am I protected by the transitional provisions ? as i applied before june 2012 .
2- If i am not , did i lose all my rights of residence since 2014(work,stay...)?
3-which application i have to make before my residence card expires on DEC17, should i apply for PR under EEA rules , or switch to the UK rules as my wife is british now, and make the FLR(M) application?

Please i need help ,
your answer will be much appreciated .
