applying for RC without being married

Friends of mine would like to apply for RC:

she is a member of the EU and the they are not married but live since 3 years together in a relationship.

so what exactly do they apply for ?

Individually apply for the RC, if they are both EU.

she is latvian and he is algerian ( not legal in the country )

they have tried to get married but have been refused. is there anything they can apply for at all ? so he is known to the HO as they got referred to them for the interview.
they got a rather horror interview however they are still together and really want to start a family but they cant as he isnt legally here.
