Do I need a Deed Poll?

Post by Manu99 » Sat Nov 11, 2017 1:11 pm

Hi guys, please i need an urgent advice regarding my case.

I came to UK with refugee travel document with eea family permit and i got my residence card last year as am married to EU national. This refugee travel document is expired and i had to apply for passport from my national embassy. I got a new passport from my national embassy but there is a slight issue, my name on the new passport spells different from my travel document and the residence card. I think need to apply for a new residence card to replace it to match my name on the new passport so i don't have problems when traveling but my question is,

do i need a deed poll to send Home Office with the new application or there is no need ? My name is the same but only spells different.

Please advice.

The main issue may be that you have requested (and obtained) a passport for the same country that you have claimed asylum from.

Hello Casa, thanks for the reply! I believe that shouldn't be an issue to Home Office. As the country where i claimed asylum from does not mind if i have a national passport beside their refugee travel document, however the travel document is already expired and not valid anymore.

The Home Office released a new policy in March 2017, which includes the following:

"The Home Office instruction says that the right to stay in Britain may now be refused if there has been “a significant and non-temporary change in country situation”, a change in personal circumstances, the refugee has returned to their country of origin or obtained a national passport from that country."

In applying for a passport from the country from which you have sought asylum, you have placed yourself once again under its protection.

This should apply on people who has British refugee status in the UK no? I dont have any refugee status in the UK, as am here on the bases that am a direct family memeber of EU national that should not effect me i believe.
