Help needed

Hi Noajthan,

You have been really helpful whenever I needed some advise. I’m in need of your help again. My application for eea pr (non EEA family member) was refused on the basis of my dad (the sponsor) had been claiming job seekers allowance for than 3 months or 91 days. I have logged for an appeal already. Could you please guide me what evidence do I need to collect as evidence that will support the application. My dad had been actively seeking work all that period. He was claiming job seekers allowance for during all that period, being on job seekers is prove of its self that the particular person is actively looking for work or his claim gets discontinued. Could you please please help me suggesting what I need to collect that will help me in the court to support my case.

You will be required to submit documented evidence that your EEA sponsor has been actively seeking work or undergoing Vocational training during his period of unemployment and while he has been claiming JSA in excess of the permitted 91 days.
(Casa, not CR001)

Thanks for your reply casa. I’ve been looking online and found this new JSA rule came in 2014 when a EEA National could only get JSA for not more than 3 months. Before this rule was applied there were no restrictions on how long you could claim job seekers for. Is it possible for my Dad to get PR for the period when the rules were not changed ? The period he claimed job seekers was from may 2011 to September 2013 during this period he’s wasn’t medical fit to work as he had an accident and when he got better he started looking for jobs, went for vocational trainings as well during period.
