ILR, Tier 2 and UK born children

Post by beantat » Tue Nov 14, 2017 8:47 pm

Hi, I am wondering if anyone could help me.

1. I am a Permanent Resident (ILR) visa holder basis on 10 years living in the UK. I got this on 2013.

2. My wife has been living with me in the UK for 9 years on her own visa - student, dependent tier 2, student and now on tier 2. Her visa is going to be expired by Jan 2018. Her sponsor don't have any problem to extend for her tier 2 visa.

3. My children were born in the UK and not a British passport holder as my country won't allow for dual citizenship. However, their visa is dependent to my wife's visa and will be expired the same as my wife's.

So, my question is what is the best visa for her to apply before her current visa expired in terms of the easiest requirements etc? FYI, she has few options:
  • Family visas
  • ILR (Not sure if she can apply under 10 years route yet?)
  • Extend tier 2 with her sponsor
Much appreciate for your help on this.

Thank you.

As she is aiming for 10 year route, it does not matter really. I say she extends the Tier 2 general as it will be cheaper that FLR(M), unless she wants to work for someone else.
