Question regarding ILR eligibility

Post by omi007 » Wed Nov 15, 2017 8:29 pm

Hello Moderators,

Many thanks for your guidance and spending your precious time to answer our queries.

I will be applying for ILR next week, and want to make sure, about my eligibility for the application.

My visa type: Tier 2 General

Below are my timelines:

* UK Entry Clearance Visa issue date: 08 Dec 2012
* First entry in UK: 25 Mar 2013

UK Absenses
----------------------------------------
Date Left UK - Date Entered UK - Reason
04 Apr 2015 - 14 Apr 2015 - Personal
28 Feb 2016 - 08 Mar 2016 - Personal
13 Apr 2016 - 26 Apr 2016 - Personal
29 May 2016 - 14 Jun 2016 - Business
08 Oct 2017 - 14 Oct 2017 - Personal
----------------------------------------
As we can see, there is difference of 107 days between entry clearance visa issue date and actual first entry date.
But my understanding is, we can count 5 years ILR continous period from entry clearance visa date, if this difference is less than 180 days.

Therefore as per my understanding, I can apply after 10th Nov 2017.

(08 Dec 2017) - 28 days = 10 Nov 2017

Can you please let me know, if my understanding is correct and I am safe to apply for ILR in the next week.

Many thanks.

Yes, you're correct. You can apply any time for ILR now, provided you score all the points. As far as 5 year continuous period is concerned, you are fine.
