Home Office Inspection - Decision

Post by ramsrid » Fri Nov 17, 2017 5:34 pm

Hi,
Recently, there was an inspection by HO at my supposed employer's after 2 years. It is understood that all was ok except for a couple of misses with updates on Sponsor Management System, not entirely sure of the details. However from what I understand, looks like a couple of employee's names weren't deleted on SMS sometime 3 yrs ago even after they had resigned. My Tier 2 change of Employer's application is on hold because of these background checks on the sponsor. Can someone please advise on the worst outcome for the employer in this situation.

Regards
RSrid

Hi ramsrid,

We had a similar situation recently. Have a look on this thread. You'll find something helpful.

Hi crazy_p,
Thanks much for your response . Yes I am aware of the options. However I was checking on the probabilities of response/outcome from HO to my employer for the specific 'Miss', by my employer - Failure to remove a couple of names from SMS during the years '12 and '13, that was queried during their visit.

Employers/sponsors have been known to get away with small misses like the ones you have pointed out by just a slap on the wrist. You can generally tell if the HO respond quite quickly to the sponsor post audit / compliance visit. However, once HO have highlighted the discrepencies, you should get your visa sorted our pretty quickly. Might need a chase?

Hi FieldDrive,

Even my employer was questioned with same mistake...so you are saying our visa should get in next couple of weeks. as I went for premium service?

Look every situation is different. I was saying generally speaking if HO are satisfied that the sponsor is not acting in bad faith, they can let a few instances of non-compliance slip. However, I must say I have made a whole bunch of assumptions about the sponsor as in not just acting as a resource provider, etc.
