Hi I'm working as a doctor with one of the NHS hospitals since may 2016. Since my visa (tier 1 general- HSMP, judicial review) was expiring on 17th Nov, 2017, I applied for switching to tier 2, getting a sponsorship letter from employer ( Start date on sponsorship letter from 16th of oct, Labour market requirements- met). Visa has been refused, the employer did nt fullfil the requirement for advertising the job, got 0 point for that. Administrative review can be applied. When spoke to the manager , they told , since switching from tier 1 to tier 2, plus already in job, they think it is not required. My question, are there any exemptions from Labour market test, when switching from tier 1 to tier 2, plus already in job? If not now what to do from onwards, administrative review, if refused? New application? Thanks and best regards.
