Pension Scheme (Tier 1 E) and overlap in one job

Post by sm12 » Mon Nov 20, 2017 8:20 am

One of my employees whose assessment for pensions was postponed for the duration of his probation has now decided to opt out of his pension scheme. I remember there were a few members who were interviewed about whether their employees were registered for pensions, and I just saw another thread about something similar on another board on here.
Would this be a problem with extensions/ILR, i.e. would HO flag it up that the employee is not making pension contributions as per the payslip?

Also, if one employee replaces another, and suppose they both work in the business for about a week, then how do I fill the table in the form?
Will HO accept the overlap as one job?

Thank you.

Just fill it with the correct start and end dates. Start date of second employee is before the end date of 1st employee.
There should be no problems with accepting that.
However, since it is job not employees that HO counts, you only get credit for 1 week, not two weeks in the overlapping week

Seek advice from a pension advisor. HO expect you to correctly follow the rules regarding the pay, pensions, work, etc

Thank you Marcnath and Zimba.
I spoke to the pension scheme provider, and confirmed that the employee decided to opt out.
Seems this is perfectly acceptable, but the other employees are still enrolled.
Should I write about this in the cover letter when applying, to explain why he is not making contributions?

This is not relevant to immigration rules as repeated several times. Please seek advice for such compliance from professionals :!: :!:
