Judicial Review for asylum case

Hi,

My husband came to the UK following persecution in Eritrea in 2005. His initial claim for asylum was refused as we're all further fresh claim. Most recently he made a fresh claim in 2014 and included our marriage (I am a British citizen) and this was also refused. The solicitor recommended that he makes a judicial review as the decision did not look at the new evidence that was submitted and was not legal and with good reason. The home office maintained the refusal when he made the pre action protocol, and he has applied for judicial review within the 3 month deadline. The application before permission for judicial review was made on 10.10.17. There has still been no response.

My question is how long does it take to get permission for judicial review? Also if he gets permission, is there a possibility the Home Office will review their decision without having to go through the judicial review?
