I was previously a student in the UK, I was recently withdrawn from my studies. I attempted to appeal the withdrawal, and the process took a few months and I was advised to go home while they processed the application. Long story short, the appeal was unsuccessful I had to go back to the UK to pack my things. I could not re-apply at another University as I no longer met the UKVI academic progression requirements.
After checking with several student agents, I was told I was able to re-enter provided I enter as a tourist, instead of a student. Because my now former university had told me they had informed Home Office of the end of my Tier 4 Visa sponsorship a few weeks prior to me leaving for the UK, I decided that I had to disclose everything to the Immigration Officer as I assumed that had a record of this.
I had been in the UK for 6 years, I started with my GCSEs, and was a semester away from graduating with a degree. Because I was always so busy with my studies, I had never done anything touristy whilst I was there. I decided to stay for a little over a month, as I am aware, a non-visa national is permitted entry without a visa for up to 3 months. Specifically, 43 days as the return tickets were much cheaper a few weeks after my originally planned return date.
When I arrived at Heathrow, I went with my father. We both explained the situation to the Immigration Officer. I explained everything to the Immigration officer, but he seemed to be extremely caught up with the length of my stay over anything else. I was then detained for 11 hours, interviewed and finally allowed to leave as a person with temporary admission who's liable to be detained. However, my dad was let through. And I've now got that cross on my passport.
Recently something urgent has come up that requires I go back to the UK. I had intended to return on a visitors VISA as the immigration officer had advised, but as I said something very sudden and urgent has come up and I wouldn't have the time to apply for the visa, even with the overpriced express service.
I was reading on other websites that I could re-enter and it was at my own risk as the decision would be up to the specific immigration officer I will encounter. I was also reading that I may increase my chances of being allowed entry if I provide documents that prove I am a genuine visitor. For starters, I only need and can only be there for about 10 to 13 days. I can provide the return ticket, I have also been accepted into a University in Australia and can provide my acceptance letter and Certificate of Enrolment. If I am able to return without applying for a visitor's visa, I will then be travelling with my father and could provide my birth certificate to prove that he is indeed my father.
I can also provide things to show that I cannot stay for long, like a driving license exam appointment date, and a family holiday trip all in the coming month.
With that being said, I have also read 1 post here that said that once I have been given that cross, I will always need to get a visitors pass.
I need a definite answer as soon as possible.
