ILR for Tier 2 Dependent with 2nd Entry Clearance Outside the UK

Post by bbreddy » Thu Nov 23, 2017 11:59 am

Hi all,

Below is my wife's situation:

Received 1st tier 2 dependent visa - June 2013 valid until Jan, 2016
Entered the UK 1st time - July 2013
Left the UK for maternity reasons - Oct 2014

Main applicant changed jobs in - Feb 2015 and again in Sep 2015; As I understand from other forums, dependent need not change her visa as it is only tied to main applicant. Correct ?

Wife & child applied for new visa (from outside the UK) in Dec 2015. New dependent visa is valid until Oct 2018.

Wife Returned to the UK in Jan 2016 with child.

Main applicant received ILR in Nov 2017.

Can you please advise what is the earliest date my wife can apply for ILR? Is it June 2018 (assuming 28 days early) or Dec 2020 ?

My questions/concerns are:
When my wife applied for her new visa from outside the UK, has that reset her ILR clock? Will that reset the clock even though her previous visa hadn't expired at the time of application?

As she was outside the UK for about 15 months, will that have any impact on the 'continuous residence' requirements? I read in some of the forums that this is not applicable for the dependents?

If she can apply for her ILR in June 2018 (and get it approved on the same day) and I apply for my British citizenship in Nov 2018, is there anyway I can apply for my child's citizenship application at the same time as me (i.e. without the need for applying for child's ILR along with my wife - as this will save hell lot of money).

Sorry if the case was complicated or I hadn't explained very well. Please do let me know if I can provide any other info to help answer the questions.

    Many thanks
