I am currently on Tier 4 visa, and back in September I applied for my wife to come join me as a Tier 4 dependent. Her visa was rejected because of reasons and evidence oversight by the initial ECO.
We got the rejection letter on 19th September. We decided to go to AR and on 2nd October applied for AR. On 27th October our decision was overturned and my wife was asked to submit her passport to the jerry's office along with the AR decision email print. She did that on 30th October.
I was hoping that once decision has been made, then by now she should have gotten her visa. But we are still waiting. Does it usually take this long just to giver her entry clearance? How long does it usually take?
Also during this time I was offered a position and I have to switch to Tier 2 - I have been given my Certificate of Sponsorship from my employer. I am to start the 1st of December. That means I cannot wait anymore and must avail the priority or premium service to switch to Tier 2. [Why are they taking so long to return my wife's passport?]
My main concern is - Once I switch to Tier 2 and before my wife's documents are returned. Is there a possibility that her visa decision would be overturned? Since I, the main applicant, changed status.
Or is that not a problem and they would not rollback the decision after me switching to Tier 2.
I plan on changing her to Tier 2 AFTER she comes here as I do not want to go through the same ordeal of rejection and AR again.
