Regarding Spouse name change on passport when in UK and not on BRP

Hi,
I am currently in UK on Tier 2 ICT Long Term Staff Visa which is valid till April 10, 2018 and can be renewed for further 2 years.
My wife is currently with me In UK on Dependent visa,I have recently applied for passport renewal for myself and my wife (as my passport was abt to expire this year),
In the application I requested for change of name (surname after marriage) for my wife in her passport and to update the same in my new passport.

Because of this now there will be discrepancy in her names on new passport and BRP card which she have.

She is planning to travel to India for 6 month starting from Jan 2018, in this reference I have below 3 queries,

1. Will the immigration officer allow her to travel with different names on BRP and new passport, while she will be carrying old passport as well

2. Can her visa renewal be done while she is in India

3. Or do I need to get her name changed on BRP before doing all this

1. As long as she carries her old passport as well which has her previous name, I think it should be fine. There is no mandatory requirement to change the name in the BRP.

2. Yes, she can renew her visa while in India. You will need to get it extended in UK first before she could apply from India.

3. BRP update is not reqd. When she applies for renewal, she need to mention her old name as well in the application form (I think there is a question on other name the applicant was known as).
