My route to become a BC - 10 year ban or not?

I would like to hear an opinion of fellow members about whether or not I will receive 10 year ban due to overstaying my visa?
I came here in 2010 on Tier 4 visa which expired on 1st December 2011. Got married with EU citizen on 17 December 2011. Applied for non-eea residence card in mid 2012 and received it feb 2013. Now Im about to apply for Permanent Residence.

So, my question is have I breached immigration rules by staying in UK without any status between 1/12/2011 and 17/12/2011? I heard about 28 days rule that does not lead to automatic refusal for BC, because according to EU law I acquired legal status on the day of marriage.
And what will be the date of my BC application - 17/12/2017(5+1 year or acquisition of PR), 17/12/2021(10 year ban) or February 2023(10 year ban since receiving residence card)?
