Tier 2 Dependant to ILR (Two Questions)

Post by jimmylin » Sat Dec 02, 2017 4:43 pm

Hi, wondering if anyone can help me here.

My wife will apply for ILR soon, she is currently on Tier 2 dependant visa.

1. in the application form section 6.3: She has some absences over the past 5 years. Does she need to provide a "Letter from applicant detailing reasons for absence due to compelling or compassionate reasons"?
If yes, can she just say the reason is to visit parents in her home country?

2. in the bottom of Section 12A (Page 74), The form says "If you have a spouse or civil partner listed in section 2 of this application form who is applying at the same time as you, please provide documentary evidence of cohabitation since you were last granted leave (up to a maximum of two years). Evidence provided should cover the whole period and be in the form of official letters or documents, addressed to yourself and your spouse."
She will be applying herself with a kid, does this mean that she doesn't need to provide any evidences of cohabitation?

Thanks in advance.

PBS dependants have no absence requirement

No. She has to provide cohabitation evidence as her ILR is based on her subsiding relationship with you
