Heelp! UK fiance Visa

Post by ornela_albania » Sat Dec 02, 2017 10:21 pm

Hello everyone.

First I apologize for my grammar mistakes. The reason why I am writing, it’s because I’m totally freaking out about my fiancé visa application.
I applied from Albania, on 1st November 2017, to join my fiancé in London. We send all the documents which include:

- My personal and family certificate
- English Exam – ITLS
- Letter from police confirming I don’t have any criminal problem
- I had a blog about my Long Distance Relationship, which I decided to delete it later. I printed everything, my essays, and screenshots where he reacts bout it.
- Screenshots of our conversations, whatss app, facetime, messenger, instagram
- Pictures of us

And from my fiancé:

- House contract (on his parent’s name) and a letter of invitation from his mom. He lives with his mom, two sisters and a nephew. It’s a house with 4 bedrooms. We said we were living there, because we want to get to know each other better.
- His birth certificate
- We already booked our wedding date in Mosque, on 28th of March and documents that proved we paid for it.
- Copy of his passport at a solicitor (we did this in Albania)
- His work contract, he works as a brand manager and his year income is £ 30,000. He also has a son so every month he pays £ 222 for him.
- P60
- Bank Statements, his savings are £3000.
- We also wrote a Cover Letter, (our love story, and explained the documents we are providing).

Do I really have hope for my fiancé visa… I have been reading everywhere bout the visa and I’m afraid they will refuse it, that there are too many people living in the house and there is not enough savings. What do you Think? I have 2 more months to go and I’m going crazy everyday.

Thank you all,
Ornela

Crucial to your application...an Islamic marriage ceremony performed in a Mosque in the UK won't be recognised as legal under British law and therefore won't qualify for a Spouse settlement visa. :!:

Your fiance also needs to submit his last 6 months payslips together with the corresponding bank statements.

Only savings over £16,000 will be considered in the financial calculation.

Your fiance's birth certificate is not required.

How many times have you met in person and did you submit evidence of time spent together? :?:

Have either you or your fiance been married before? If so, did you submit the divorce decree absolute?

You don't mention your passport. Did you submit this with your application?

When you refer to your fiance's parent's 'house contract', is this a rented property? If so, you should have submitted a letter from the landlord agreeing to you living in the property. If the house is mortgaged, the ECO will want to see a copy of the mortgage agreement, or if owned outright, a copy of the property deeds.

We couldn’t book a civil wedding, because I had to be in the country. So we provided the Islamic one.
Yes, he did submit his 6 months payslips. I forgot to mention it.
We meet each other five – six time he was in my country. He stayied here every time, one week to two weeks. So I printed his flight tickets and all our pics together.
None of us has been married before. He only have a son, but didn’t get married.
Of course, I submit my passport with my application at the visa offica.
It’s not rented, they bought it and they have a mortage. We provided documents that show that.
So we don’t have those kinds of savings. Do you think our visa will be refused even tho, his incomes are 30000 £ a year?

Agreed. If they grant a fiancé(e) visa, then you must also get legally married prior to your FLR(M) application.

As long as you satisfy the fiancé(e) visa requirements and the specified evidence relating to income in Appendix FM-SE, then you should be okay.

The ECO may question the fact that you have only submitted evidence of an Islamic marriage, which won't be recognised. You should have at least provided proof that you have been in contact with the Registry Office to enquire about available dates etc, quotes for wedding invitations/venues for the wedding reception etc. Proof of firm bookings aren't required.

As Vinny has already advised, you appear to meet the minimum income level.
