Recent criminal record in the USA

Dear forum members,

I have been legally staying in the US for about 20 yrs. I started as a student visa and eventually got my work visa and was 2 years away from getting my green card.

I was a stock broker in the states and unfortunately got mangled up in a securities fraud allegation to which I plead guilty. I was given no time and the judge also mentioned the unfortunate situation on how I got mangled up in it and if it was up to him he would have not pressed charges.

All said and done, I am still a convicted felon in a be States and due to being on a visa I had to voluntarily leave which I did.

I am intending to apply for a Enterpreneur Visa. I meet all the requirements except the one where my record will show up.

I wanted to know if this is a complete NO NO rejection for me or should I still apply and place forth my case and details about it.

Any person in a similar situation/criminal record and is applied and be won successful ?

Any advice/guidance will be appreciated.

There are a number of factors that affect your case.

Section 320 (18A) states:
Grounds on which entry clearance or leave to enter the United Kingdom should normally be refused
(18A) within the 12 months prior to the date on which the application is decided, the person has been convicted of or admitted an offence for which they received a non-custodial sentence or other out of court disposal that is recorded on their criminal record;
.

So, one, it depends on when you were convicted.
Even if it out of 12 months, there are a number factors the officer will look into.

You must get an overseas criminal record certificate from the USA as a part of your Tier 1E application. Your conviction COULD influence your UK visa application
