Will the Road Accident impact my ILR Application??

Post by RaghuKarnati » Tue Dec 05, 2017 10:30 am

On 1st November 2017, I bumped into the car in front of me on a motorway. It is just the cars that got damaged a bit, no persons were harmed and no police involved in this incident. I got full driving License and comprehensive insurance cover. The Third party claimed on my insurance as it is termed to be my fault. My insurance company payed out the Third party car repair costs but are still in a process of dealing with the personal injury costs as the third party claimed he got a neck pain (Whiplash) after the incident. Third party is due to submit a medical proof and then my insurance company will analyse the medical bill and will have their say about how much they can pay. This is on going at the moment.

The Third party sent a claim form to my insurance company and I got a copy of it. In this claim letter, there is a line that says "Was this incident reported to the police" and the answer says "Yes".

I am a Tier 2 (General) migrant and am eligible to apply for my ILR in the next month (5th Jan 2018). I am in a big dilemma, if this incident is going to effect my ILR application. So my questions are:
1. Is this incident going to effect my ILR application, If Yes, how worse is it going to be?
2. If no, Should I mention this in my ILR application?
3. The third party claim letter says, this incident is reported to police. So will this appear as a police case filed on me. Is this going to appear in the CRB (DBS) checks?
4. What steps should I take to make sure I get my ILR smoothly?

Please help me with the expert/experienced answers.

1. Is this incident going to effect my ILR application, If Yes, how worse is it going to be?
Just because third-party report incident to the Police it does not mean you're convicted of crime. A lot of people do this just to be on the safe side. Unless you are convicted, which you will not be as per your post, you don't have to worry at all.
2. If no, Should I mention this in my ILR application?
No.You don't have to mention anything unless you get letter from court or police
3. The third party claim letter says, this incident is reported to police. So will this appear as a police case filed on me. Is this going to appear in the CRB (DBS) checks?
No it will not appear on your criminal record. As I said before you're not YET convicted.

4. What steps should I take to make sure I get my ILR smoothly?
Nothing at the moment.
