7 year child route

Post by ROXO001 » Wed Dec 06, 2017 12:40 pm

Dear ALL,

Appreciate any feedback and your kind response.

I came to UK under Tier 4 as a student for my degree along with my husband and two daughters then aged 4 and 8 respectively,
upon completion of my degree my visa was extended to a masters and completed the same.
my visa expired in oct 2015 however before the deadline I applied for a flr in order to secure a phd or a dba course along with the various universities communications as evidence.
I was very unfortunate and my proposal was not accepted by some UNI's and some came back stating they full for the applied semester etc,

I also had a childbirth in 2014,
HO refused my FLR in June 2016 with no appeal rights , my lawyer applied judicial review and that too was refused in November 2016.
I was given a letter to sign monthly at the Beckett reporting centre since 2016 December . however this was extended to yearly when I visited September 2017. i.e. my next sign in is September 2018.

my solicitor has sent "further representation" which included polling cards, council tax, certificates and progress reports of my children, my awards and certificates, pictures, letters from head teachers to the home office in the same month December 2016 after I received the document to sign in, I also understand this letter to sign in was issued due to a delay in compiling of my documents by my solicitor, not sure whether its correct.

I am highly worried with all these incidents,
as my two elder daughters have completed 7 years now ( aged 15 & 11)the solicitor says that I can apply for a 7 year fresh application which cost me like £8000 for five members (including IHS)

Further I have to add , I had to leave the house in Aug 2016 which we lived in for 6 years due to landlord selling the house and we could not find any due to immigration control.
thus No recourse for public funds team from social services of the county we lived in has given us temporary accommodation after an assessment of my children and my family.

my two daughters are extremely doing well in terms of achievements, discipline, progress and are award winners from their schools including younger one winning princess Diana award for young leadership qualities and been a role model in school .

please let me know whether there is any positive aspect on this in applying for 7 year route.

thank you
god bless

The 7 year child route is a misnomer. The rule is 'best interests of the child(ren)" and UKVI takes the view children are adaptable.

Not an easy path or get out of jail card I'm afraid...

thank you for your reply, I am not too sure what to do,

my solicitor say whilst we wait for a response on "further representation" they sent we can proceed with the application, I too have second thoughts.
