ILR Question

Hello IB Team, my question is as follows
I have been working in UK since 22 Feb'04 on a work permit. Living along with my wife since then and was out of the country for only 50-52 days. My employer changed on 19 Mar'07 and the WORK PERMIT transffered over by TUPE rule. As per the current rules, I am elgible for PR or ILR after 22 Jan'09. My wife works as full time permanent employee with a bank and she is now on maternity leave and she delivered a baby boy on 27 Feb'08 and I am planning to send her to India for her maternity leave which will end on 10 Feb'09. Now, If I want to apply ILR, should my wife and child with me for applying ILR or I can just submit their passports along with my applicaiton or I can add them later to the ILR application and also would like to know if this would affect my ILR application.

Would appreciate if you can answer this ASAP as I have lot to decide on this.

Sorry that was a typo error, yes, I know its now for 5 years. I have corrected that while you were replying...thanks..
