Naturalisation - Non-EU spouse living in a different country

Post by apopa » Mon Dec 11, 2017 7:29 pm

Hello,
I am wondering is anyone can help me with advice. I am a EU citizen and I am planning to apply for UK naturalisation and I had to specify the fact that I am married. However, my spouse does not live with me at the moment. He is completing his studies in his country. He is a Non-EU citizen. Do I have to justify in any way why we are living separately? I am applying alone at the moment, but I dont know how my situation will affect my chances of getting the citizenship.
Thank you.

Your marital arrangements as such are not a hindrance to your application, just state the facts as they are. One thing to remember though is that once you are a British citizen you may not be able to sponsor your spouse under EU regulation, and UK immigration laws may apply, with minimum earnings requirements, etc. The more experienced members/moderators will be able to clarify- this is a complex area.
This is just my opinion as a member of this forum and does not constitute immigration advice.

Thank you so much for your reply. It worries me though that HO might question my intentions of making UK my home since my spouse is living in a different country. I have asked my spouse to provide me with a proof letter of his studies, however the institution he is attached to has refused issuing such a letter. I dont want to give HO any reasons to reject my application and for me to lose all that money.

You're overthinking this.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Should I attach any documents to the application, such as a declaration regarding my spouses's whereabouts or just mention I am married and he lives in a different country and just hope for the best? I have read through the boards and I haven't seen another situation such as mine. I have asked him to provide a signed declaration that he is a student in his home country at the moment and this is why we live separately.
I know I may overthink things, but knowing how HO reacts, just wanted to make sure I cover all scenarios and not give them any reason to reject my application. :?
Other than this, my application is quite straight forward. After completing my studies in UK, I have joined the company I currently work with and worked with them ever since. More than 5 years now.
