Continuity of business after fresh application

Post by Rykhan » Sat Dec 16, 2017 2:14 pm

Hi all respected senior members especially Zambia and mcnarth need your advice
I have posted my fresh application after my extension and AR refusal here my question is am I allowed to continue my business as a unpaid director and my company is leagally allowed to carry on business activities to pay all expenses and employee wages.
My 2nd question is am I allowed to change my business during fresh application in progress if yes did I need to inform home office as well. Thanks in advance for your valuable advice.

Yes, though you are an overstayer your business can continue. Your business and you are separate legally. So your business is legally able to continue.
And yes you can change your business there is no need to inform HO.

Thanks Marcnath for your valuable advice so that’s mean during that overstay period I can register a new company with new business and did I need to invest £50,000 again or there is no limit for this. Thanks

There is no requirement to invest again for your Visa reasons.
Also, there is no restriction that I am aware of that stops you from starting a new business (at least if there are it has nothing to do with the T1E rules).
However, when you open a bank account for the new business, the banks may look at your immigration status. Again, I don't think there is anything that would prevent it, but it will be up to the individual bank.
