Tier2 RLMT

Hello every one
I have recently (in Oct) resigned to my position with my tier 2 sponsoror due to some personal issues.
They informed this to the home office through SMS, And i have been waiting for the curtailment letter. But now i am thinking to join back with my old employer and they are quite happy about it. but the big question is do they need to do the RLMT (Labour Market Test) before issuing a new COS for the old employee as well.

Yes, they'll need to do RLMT again. The whole process will be done as before when you initially joined.

Also, provide your complete immigration history so far. Including the date you left last employer. (last working day)

my last working day is 20th oct 2017. initially i switched from tier 4 to tier2 so i am exempted from RLMT after working with them for 2 years i resigned in oct.

that's fine then. You just make sure you ask employer to assign your COS after 11th Jan 2018 so that you don't fall in the rules where if you have more than 60 days gap between two employers you are not eligible for ILR.

I didn’t understand, why after 11th jan..?and what is this 60days rule.as my last working day is 20th October i have already reached the 60days limit,and for the RLMT again they will need 28days that will be near to 90days so will i not be eligible for ILR..? Please help

Currently there is a rule that if you have had more than 60 days gap between two employers then you cannot apply for ILR.

This rule is going to be removed and the effective date is 11th Jan 2018. So if you get COS after 11th Jan 2018 then your previous gaps will be disregarded and you'll be eligible for ILR.

You're welcome. Just make sure they assign COS before 11th Jan 2018. This way you can apply ILR later on.
